Visa Overstay Illegal, Delhi High Court Issues Key Ruling

In a landmark judgment, the Delhi High Court has made it clear that foreign nationals have no right to stay in India after the expiration of their visa. The judgment has reinforced the strict immigration rules.

The court dismissed a plea made by a Nigerian student seeking an extension of his visa to pursue his studies. The court ruled that overstaying in the country after the expiration of a visa amounts to illegal stay.

The facts of the case were that a foreign student, pursuing a three-year undergraduate course, had overstayed in India long after the expiry of the visa. He had approached the court and sought permission to extend the visa and complete the course.

However, the court opined that the student had already spent nearly eight years in India, trying to complete a three-year course, and had not been able to fulfill the requirements.

The judges opined that the petitioner could not justify the long stay and did not have valid grounds to seek the extension.

“No Right to Stay After Visa Expiry”

In its observation, the court clearly stated that once a visa expires, a foreign national has no right to stay.

The bench clarified that the government has the full authority to take action against foreigners who stay beyond the visa period, as per the Foreigners Act, 1946.

The court observed that the petitioner was an illegal migrant, staying in India without a valid visa for a prolonged period.

An important feature of this judgment was the lack of compliance on the part of the student with academic standards. The judgment emphasized the point that even if the issue of the visa was treated separately, the student had not complied with the requirements of the university.

It has been reported that the student had failed in maintaining the minimum attendance, had not cleared the examinations required to be taken, and had not been able to complete the degree within the stipulated time frame.

The judgment emphasized the point that no person, whether Indian or foreigner, could remain in the academic course indefinitely.

Impact on International Students

The case has also highlighted the significance of academic as well as visa compliance for international students. Universities and international students must ensure the timely completion of their courses and visa renewal procedures.

Non-compliance with these procedures may lead to the rejection of visa extensions and the consequent loss of their legal status in the country.
